Construction Accident Injuries
|
Construction industry is accident prone that sees more deaths annually than any
other private sector. In fact, it is the largest U.S. industry and it constantly
registers high rates of workplace accidents. Though the Occupational Safety and
Health Administration (OSHA) has deployed a large amount of its enforcement to the
construction industry, it is yet to reduce injuries and fatalities in that field
significantly.
It is also a fact that construction sites expose workers to a wide variety of risks
and hazards, many of which are avoidable. The contractors should ensure:
- measures to decrease worker and passerby injury risks including
- proper training of employees
- proper maintenance of construction equipment
- posting warnings in hazardous areas, and
- supervising construction sites.
The types of accidents with high frequency includes:
- Crane and Lifting-equipment failure accidents
- Being hit by operating equipment
- Compressed-gas accidents
- Welding accidents
- Fires and explosions
- Electrocutions and shock
- Elevator shaft accidents
- Building collapse accidents
- Roof related falls
- Trench collapses
- Struck-by heavy falling objects
Not only the construction site contractor, but other parties also may be singly
or jointly be financially liable for damages in a construction accident which may
include the landowner, general contractor, subcontractors, architects and engineers,
equipment manufacturers and insurance companies, etc. The degree of liability may
depend of who is in legal control of the construction site at the time of the accident
and nature of error or negligence committed by the respective parties. In some cases,
the contractor assumes the responsibility for injuries and fatalities from construction
site accidents, and any associated financial damages.
The claimant can claims against the abovementioned parties in addition to the compensation
under various workers' compensation laws.
